These policies may be amended from time to time without notice. Registering an account on Ridgetec.com constitutes an acceptance of these Terms and Conditions which describe the policies for the Ridgetec.com website and mobile applications (collectively "software and services").
Billing Cycle: Billing Cycles, assigned as the day of the month a member makes his/her initial purchase, are used to determine when accounts will be next billed and based on the duration of the plan. A billing cycle will run through the end of day on the day prior to the billing cycle day. Billing cycles will be assigned a value from 1 to 28.
Services: Data Plans, Storage Plans, Memberships or other services which require the initial purchase and/or service payments.
Devices: Primarily RidgeTec cameras that may be activated using the RidgeTec account.
End User: Any and all users which use a login to gain access to the RidgeTec website and/or mobile applications, whether direct login is entered or associated with another Social account such as Facebook or Google, whether person or business entity.
Payment Method: Any credit card, PayPal account or other acceptable payment option by RidgeTec which the End User is legally authorized to use.
Wireless Carrier: Any company that provides wireless service to RidgeTec for the use of allowing IoT devices to communicate to RidgeTec servers.
Legal Notice: Written communication between one party to the other that advises of termination of this agreement or otherwise required by this agreement.
Notifications: Notifications from RidgeTec will be sent to the Email address associated with the End User's RidgeTec login. It is the End Users responsibility to verify that emails from RidgeTec do not get put in a Spam or Trash folder in the End Users email client. End User is also responsible for verifying and checking the provided Email address for notifications from RidgeTec. All emails from RidgeTec will originate from the RidgeTec.com domain.
The End User agrees to the terms and conditions set forth in this agreement for a term of one month. At the end of this term the agreement shall automatically renew monthly until either party provides 30 days prior notice to the other party to terminate.
The End User acknowledges and agrees that prior to subscribing to any wireless service from RidgeTec that End User has had the opportunity to independently investigate the wireless service provided in the area intended to be used in connection with the Device and its authorized use and is not relying on any representation, guarantee or statement from RidgeTec.
End User expressly understands and agrees that the services purchased through RidgeTec does not create any sort of contractual relationship whatsoever with the underlying wireless service provider or its affiliates or contractors and that End User is not a third party beneficiary of any agreement between RidgeTec and the underlying carrier. End User hereby waives any and all claims or demands therefor.
The End User agrees that the operation of any Device activated through RidgeTec is the sole responsibility of End User.
End User is responsible for verifying the Data Usage of all Devices activated by End User or on End User's behalf which is accessible with End User's login and agrees to pay for any/all additional charges for overages within the following billing cycle.
RidgeTec does not require a contract for any of its Data Plans or other services.
All Services purchased may be automatically renewed until the End User turns off the Auto-Bill option for that service. when End User elects to use the Auto-Bill feature, then End User authorizes the RidgeTec portal to automatically charge the Credit Card on file for End User's account the full amount for the plan chosen for the full duration.
All data plan purchases are non refundable and unused plan data expires at the end of the plan period.
The standard data plans are billed for in advance. At the time of point of sale, End User selects the service plan which is represented clearly with duration and full cost.
Some service plans may be initially offered with a FREE first month. Any renewals of these same plans will be at full price and the free month applies only to the very first month.
End User agrees to use either a Credit Card, PayPal or other allowable payment method when purchasing a Service and agrees to authorize RidgeTec portal to automatically charge such payment method for future renewals and/or overages. End User further agrees to keep a valid Payment Method on file with RidgeTec at all times so such services may be billed for without declines. End User also agrees that End User will only utilize Payment Methods for which End User is legally authorize to use.
All data plan purchases are billed for in entirety for their initial and stated duration. Should End User elect to use the Auto-Bill option, then on the next renewal there will be a proration or discount applied based on the users existing Billing Cycle. If this is End User's initial plan purchase then a Billing cycle is assigned and there is no proration on subsequent recurring billings/renewals for this data plan.
All media file uploads to the RidgeTec portal will consume data from end User's Data Plan or Data Reserve.
As End User's device sends media files to the RidgeTec portal, data usage will be deducted from the plan's issued data in MB (megabytes). When/if a data plan is renewed, then the plan's initial data will be reset and any remaining data is not carried forth or retained.
End User may elect, at any time, to manually purchase a Data Reserve. The value of the Data Reserve does not expire. When a data plan is exhausted, a data Reserve may be used to keep the plan active and provide data for camera uploads. Should End User elect to use the Auto-Reserve feature then, End User authorizes RidgeTec Portal to automatically charge the Credit Card associated with the account for the Data Reserve amount specified for Data Plan, when/if the Data Reserve is exhausted (its value is 0).
If at anytime during the plan period, plan data is exhausted, data usage will continue to be deducted from the plan's Data Reserve when available. If there is no Data Reserve or the Data Reserve is exhausted then the plan associated with the Device may be suspended (this depends on billing options chosen). End User agrees and authorizes RidgeTec to suspend service for any plan which has fully used its plan data and data reserve in entirety and so configured by the End User.
In order to re-activate a data plan that is Suspended, the End User should click the Renew Plan or Renew Pool Button button. The point of sale transaction and price will constitute the full amount for the plan chosen (Renew Tier).
End User understands that by changing the plan's Billing Option to DO NOT BILL, the RidgeTec portal will no longer charge his credit card on file in any automated fashion.
A Dormant Data Plan is considered to be any data plan in a non active state for over 24 consecutive months. A Dormant Account is a user account where all associated Data Plans are now in a dormant state. RidgeTec reserves the right to close any Accounts which have been dormant for over 90 consecutive days. Any Closed Accounts may forfeit remaining Data Reserve amounts.
Remote Control/SMS Messages: Ridgetec reserves the right to process per item charges for SMS commands sent to the camera while running with Remote Control active. SMS Commands are customer initiated. These charges will be pulled from the Data Reserve associated with the data plan. Ridgetec provides no guarantee that said SMS messages will be delivered to the camera as this function is a feature of the selected carrier which is beyond the control of Ridgetec. If during the SMS message origination, a carrier error is encountered, there will be no charge for this sms message.
RidgeTec makes no representations or warranties whatsoever, directly or indirectly, express or implied, as to the suitability, durability, fitness for use, merchantability, condition, quality, performance or non-infringement of service from website, mobile application or wireless service from third party carriers. All software and services are provided "As-Is".
RidgeTec will make it's best efforts to correct any discovered defects which are deemed correctable by RidgeTec but shall not give any express or implied time frame or resolve to having it corrected.
RidgeTec will have no liability to End User: For any causes of action, losses or damages of any kind whatsoever arising out of mistakes, omissions, interruptions, error or defects in furnishing software or services.
As with all systems, software and hardware alike, constant changes are made in an attempt to improve such systems and add additional functionality. RidgeTec reserves the right to modify all aspects of it's systems and cannot guarantee the compatibility, functionality or usability of features for future updates.
RidgeTec reserves the right to bring the system down and to make it unavailable from time-to-time, at any time and for any duration whether this time is for applying updates, updating servers or any other reason deemed necessary by RidgeTec.
Wireless Service uses radio technologies and is subject to transmission and service area limitations and interruptions caused by atmospheric, topographical or environmental conditions, tower availability, Equipment or its installation, governmental regulations, system limitations, maintenance or other conditions or activities affecting Wireless Service operation. Wireless Service and/or features may not be available in all areas. Wireless Service is only available within each applicable plan coverage area, within the operating range of the wireless systems, and with Equipment that is approved to operate on the respective Carrier's network.
End User shall use RidgeTec only in manners which comply with all Federal, State and local laws, rules, regulations and ordinances, including but not limited to, all Federal Communications Commission rules and regulations, all privacy and security requirments.
RidgeTec Administration retains the right, at it's sole discretion, to immediately terminate and decline future service to anyone it deems is mis-using the system or abusing its intended use.
No one under the age of 13 shall use the RidgeTec system.
End User also agrees photos taken by cameras which are uploaded and shared with others or posted to "public" areas within the website
shall not include any nudity or other inappropriate material.
RIDGETEC PORTAL ADMINISTRATION RESERVES THE RIGHT TO REMOVE ANY MEDIA IT DEEMS INAPPROPRIATE.
NO TAMPERING: Any attempt to tamper with, decode programs or otherwise use the system in a manner to avoid fees, capture unauthorized data, send unsolicited data, simulate users or cameras or perform any other unauthorized activity will result in the immediate termination of End Users account.
In addition RidgeTec Administration reserves the right to ban End User due to unwanted activity.
RidgeTec Administration reserves the right to limit End Users activities as well as change the limitations at any time.
Media Retention is 90 days for each camera. When media files become older than 90 days, they are purged on a daily basis. Make sure you have offline copies of any media files that you can't lose. Keep in mind originals are on your camera's SD card but the portal also allows you to format the SD card.
